The plaintiff alleged that the surgeon incorrectly described the cyst as a pilonidal cyst instead of a sebaceous cyst, and failed to mark the area of the cyst to be removed and also failed to verify the correct surgical site during the surgery even though a surgical time-out was conducted. As a result, the plaintiff alleged that the surgeon removed healthy tissue above her buttocks about 10 to 12 inches below the cyst to be removed.

The plaintiff alleged that she subsequently had to have the cyst drained, and then surgically removed, and that she experienced post-surgical infection complications. The surgical wound healed within several months after treatment, but the plaintiff alleged that she still has a pulling sensation in the area of the surgery and that the scar is unsightly (she declined to have laser treatments to reduce the scarring).

The plaintiff’s Virginia medical malpractice lawsuit sought general damages for her pain, suffering, and the scarring, as well as punitive damages for medical battery.
