Darien Woman Awarded $49M in Medical-Malpractice HPV Suit

The Stamford Superior Court jury deliberated for three hours Thursday before finding the defendants, Dr. Dzwinka Carroll and the Westchester Medical Group, negligent and awarding $39 million to plaintiff Jennifer Anderson and $10 million to her husband Daniel Anderson…law, Stamford Jury Awards Darien Woman $49M in Medical-Malpractice HPV Suit

Anderson was a patient of Carroll’s from at least 2013 to 2019. Carroll, as an obstetrician and gynecologist and a Westchester Medical Group employee, did not perform a colposcopy after Anderson repeatedly tested positive for high-risk strains of HPV, including HPV 16, a genotype known to place patients at significantly elevated risk for cervical cancer, over the course of multiple annual visits. The test is a standard follow-up procedure required under the applicable standard of care.

Anderson presented to Carroll with complaints of irregular menstrual cycles and bleeding in September 2019. A mass was discovered on her cervix and subsequent testing confirmed invasive squamous cell carcinoma of the cervix. The cancer had spread to her chest, abdomen and pelvis at the time of the screening, and Anderson now suffers from late-stage metastatic cervical cancer.
